Terms of Service

1. Introduction
Welcome to Displace Technologies. These Terms of Service ("Terms") govern your use of our website, the Displace CLI binary, the Displace MCP server, and all related services offered by Displace Technologies (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Accounts
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.
You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Subscription and Payments
Some features of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis, depending on the type of subscription plan you select. At the end of each period, your subscription will automatically renew under the same conditions unless you cancel it or Displace Technologies cancels it.
Starter and Professional plans are billed per managed cluster per month (or per year for annual billing). The Founder plan is a flat monthly rate regardless of cluster count. You may cancel your subscription either through your online account management page or by contacting Displace Technologies customer support team.
4. Free Trial
Displace Technologies may, at its sole discretion, offer a subscription with a free trial for a limited period of time. You may be required to enter your billing information to sign up for the free trial.
If you do not cancel the subscription before the free trial ends, you will be automatically charged for the subscription.
5. CLI and MCP Server Usage
The Displace CLI binary and MCP server ("Software") are provided for your use in managing Kubernetes infrastructure. The following terms apply specifically to the Software:
Local Execution Model
The Software executes entirely on your local machine. All infrastructure commands (kubectl, helm, terraform, etc.) are executed using your local credentials and toolchain. Displace Technologies does not have access to your cloud provider credentials, kubeconfig files, cluster resources, or any data processed by the Software.
License Key and Tool Gating
Access to MCP tools is gated by your license tier. The Software communicates with api.displace.tech to validate your license key and determine which tools are available. You agree not to circumvent, reverse-engineer, or bypass the license validation or tool gating mechanisms.
MCP Server Protocol
The MCP server communicates with AI editors via the Model Context Protocol over stdio (standard input/output). This communication occurs entirely on your local machine between the editor process and the Displace binary. No MCP protocol traffic is transmitted over the network.
Guardrail Rules
The Software includes guardrail rules that validate infrastructure configurations. Bundled rules ship with the binary; additional rules are synced from Displace Cloud for paid tiers. Guardrail rules are advisory in nature. While the Software may warn about or block certain configurations, you are ultimately responsible for the safety and correctness of your infrastructure deployments.
Your Responsibility
You are solely responsible for the infrastructure actions performed through the Software, whether initiated via the CLI or through an AI editor using the MCP server. Displace Technologies is not responsible for any damage, data loss, or service disruption resulting from deployments, configuration changes, or other infrastructure operations performed using the Software.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Displace Technologies and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Displace Technologies.
Configurations, manifests, Helm charts, and other outputs generated by the Software using your project data are your property. Displace Technologies claims no ownership over generated outputs.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Your locally stored configurations and deployment history remain yours and are not affected by account termination.
8. Limitation of Liability
In no event shall Displace Technologies, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service, including but not limited to infrastructure deployments, configuration changes, or cluster operations performed through the CLI or MCP server.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
